Wrongful death and nursing home neglect

As our loved ones age, we oftentimes must make a decision about how to care for them. Sometimes, we or our other family members are able to step in and provide housing and medical care as needed, but many times such involvement isn't feasible. Therefore, many New Mexico residents turn to nursing homes to help care for their elderly loved ones. While these institutions carry a heavy responsibility, most of them live up to the duty of care imposed upon them. Sometimes, though, negligence occurs, and the results can be deadly.

Nursing home negligence can occur in a number of ways. For example, residents who are given an inadequate amount of food may suffer from malnutrition, which may be evidenced by rapid weight loss. Lack of supervision can also be considered negligence, especially when a nursing home resident suffers bedsores or is attacked by another resident as a result. Even medication errors can occur in these homes, leaving residents susceptible to negative reactions and overdoses.

Every year, a number of innocent individuals are killed at the hands of negligent nursing homes and their employees. When this happens, a victim's surviving family members may want to consider pursuing a wrongful death lawsuit against the nursing home. Successfully doing so could lead to the recovery of compensation which can help alleviate unexpected financial burdens that result from the negligence, but it can also give a family a sense that justice was served, especially if the matter didn't result in criminal charges.

These matters can be quite legally complex. These families will likely need to gather documentation from the nursing home, residents' statements, and even testimony from those who may have been responsible for the negligence. For assistance with this process and in ensuring that they put forth the best case possible under the circumstances, New Mexico residents may want to consult with an experienced wrongful death attorney.
